Terms of Service for Sky Volleyball Affiliate Members

1. Acceptance of Terms
By accessing and using Sky Volleyball websites, programs, or services, you agree to these Terms of Service. If you do not accept any part of these terms, do not use the services.
2. Services Overview
Sky Volleyball clubs provide volleyball programs, events, training services, and online resources for athletes, coaches, families, and affiliates across Canada and the United States.
3. Registration and Account Security
- Eligibility: Participants under 18 require parent or guardian registration and consent.
- Account Accuracy: Registration details must be complete, accurate, and current.
- Account Responsibility: You are responsible for account credentials and account activity.
4. Code of Conduct
All participants are expected to act respectfully and professionally. Sky Volleyball members enforce zero tolerance for harassment, discrimination, bullying, abuse, unsportsmanlike conduct, and violations of Safe Sport guidelines.
Violations may result in removal from programs without refund.
5. Payments, Refunds, and Cancellations
- Payments: Fees are due at registration and follow posted rates.
- Refunds: Eligibility follows each member club refund policy by location and program.
- Cancellations: Clubs may cancel or reschedule for weather, facilities, low enrollment, or unforeseen issues. Affected participants may receive a refund or credit.
6. Privacy Policy
By using services, you agree to the Sky Volleyball Privacy Policy.
7. Website Content and Intellectual Property
- All text, logos, images, video, and software are owned by Sky Volleyball or content providers.
- Content may not be reproduced or exploited without written permission.
- Submitted media grants Sky Volleyball and member clubs a non-exclusive, royalty-free promotional and educational license.
8. Compliance with Governing Bodies
Affiliates follow applicable national and regional volleyball requirements, including:
- Recruitment and communication rules
- Screening and certification for coaches and staff
- Safe Sport protocols, including Rule of Two principles
Each affiliate remains responsible for compliance in its jurisdiction.
9. Assumption of Risk and Release of Liability
Volleyball and physical activity involve inherent risks. Participation confirms voluntary acceptance of those risks. Sky Volleyball and affiliates are not liable for injury, loss, or damage except where liability is required by law.
10. Modifications to Terms
Sky Volleyball may update these terms at any time. Continued use after updates means acceptance.
11. Governing Law
Terms are governed by the laws of the province or state where the program operates. If no local jurisdiction applies, Manitoba, Canada law applies.
12. Dispute Resolution
Parties agree to attempt informal resolution or mediation before legal action.
